Derby Middle School teacher arrested on Tuesday

Derby Middle School teacher Cody Chitwood was taken into custody on Tuesday night on suspicion of two counts of sexual expulsion of a child with a $150,000 bond, according to Sedgwick County Booking Details.

According to KSN.com, before his arrest there was a two-month investigation with the Internet Crimes Against Children Task Force.

Chitwood was a special education teacher and coach. He coached multiple sports, including football, girls basketball and track. He was not arrested on school property, but on Tuesday night the parents of the students were emailed about the situation.

According to the e-mail: “A staff member at Derby Middle School has been taken into police custody and suspended with pay. This staff member was not at school today or taken into custody on school property. This is a personnel matter and we are cooperating fully with police on this. Our understanding at this time is that this matter does not involve our students or other staff. We can not release the staff member’s name because this is an ongoing investigation. Questions should be directed to the Sedgwick County Sheriff’s Office.”

The case was turned over to the district attorney’s office for further prosecution.

Also on Tuesday night, Chitwood’s stepson Nathaniel Mercer died.
